1. INTRODUCTION AND ACCEPTANCE

1.1 Who We Are

Quinns Gifts Private Limited, operating as "Quinns Arte" ("Company," "we," "us," or "our"), is a handmade and personalized gifting brand registered under the laws of India, with its principal place of business in Udaipur, Rajasthan.

1.2 Acceptance of Terms

By accessing, browsing, or placing an order on www.quinnsarte.com (the "Website"), you ("Customer" or "You") agree to be legally bound by these Terms of Use. If you do not agree, you must immediately cease using the Website and refrain from placing any orders.

These Terms are to be read in conjunction with our Privacy Policy and Shipping, Refund & Cancellation Policy (collectively, the "Agreement").

1.3 Eligibility

You must be at least 18 years of age and legally capable of entering into a binding contract under the Indian Contract Act, 1872, to use this Website and place orders. By placing an order, you confirm that you meet these requirements.

 


 

2. PRODUCTS AND SERVICES

2.1 Nature of Products

All products offered on the Website are handmade, custom-crafted, and/or personalized items including but not limited to crochet bouquets, vintage letters, photo scrolls, gift hampers, and other artisanal gifting products. Due to the handmade nature of our products:

  • Each item is uniquely crafted and may contain minor variations from product images or previous orders.

  • Such variations are characteristic of handmade craftsmanship and shall NOT be considered defects.

2.2 Product Appearance Disclaimer

Due to differences in screen calibration, device displays, photography lighting, material batches, and the inherently handcrafted nature of our products, actual product appearance — including colour, texture, shade, size, and finish — may vary from product images shown on the Website. Such variations shall not be considered defects, misrepresentation, or grounds for return, refund, or exchange.

2.3 Minor Defect Threshold

Minor imperfections inherent to handmade and artisanal products — including slight asymmetry, minor colour irregularities, small thread ends on crochet items, or minor variations in dimensions — shall not be considered manufacturing defects unless they significantly affect the usability or core function of the product.

2.4 Pricing

  1. All prices are displayed in Indian Rupees (INR) inclusive of applicable GST.

  2. Quinns Arte reserves the right to modify prices at any time without prior notice.

  3. In the event of a pricing error or typographical mistake, we reserve the right to cancel the order and issue a full refund, without further liability.

 


 

3. ORDERS AND PAYMENT

3.1 Payment Terms

  1. 100% advance payment is required for all orders.

  2. Accepted methods: Credit cards, debit cards, UPI, net banking, and digital wallets via payment gateway partners.

  3. Production commences only after full payment is received and confirmed.

  4. Quinns Arte does not store complete payment card details. All payment processing is handled securely by third-party PCI-DSS compliant gateways.

3.2 Order Confirmation

  1. An order confirmation email will be sent upon successful payment.

  2. Order confirmation does not constitute final acceptance. Quinns Arte reserves the right to cancel any order due to suspected fraud, incomplete information, or material unavailability — with a full refund in such cases.

3.3 Customization and Personalization

  1. It is the Customer's sole responsibility to review all personalization details — including names, dates, spellings, messages, and images — before completing the purchase.

  2. BY CLICKING "PLACE ORDER," YOU CONFIRM THAT ALL PERSONALIZATION DETAILS ARE ACCURATE AND FINAL.

  3. Quinns Arte shall not be liable for errors in customer-provided personalization content.

3.4 Customization Approval Liability

Where Quinns Arte provides a design preview, digital proof, or mock-up for Customer approval prior to production:

  1. The Customer must review and approve or request changes within 24 hours of receiving the preview.

  2. Once a Customer explicitly approves any design preview, personalization content, or order details — whether via email, WhatsApp, or any written communication — Quinns Arte shall not be responsible for any errors including spelling, content, layout, colour selection, or formatting contained therein.

  3. Failure to respond to an approval request within 24 hours shall be deemed acceptance of the design as presented, and production will proceed accordingly. Quinns Arte shall not be liable for any resulting issues.

Note: Standard and Express have the same production/processing time. The difference is the shipping method — Standard via road/surface; Express via air for faster transit. Rush reduces processing to 1–2 business days, then dispatched via air (same as Express shipping).

4.2 Critical Disclaimer on Timelines

ALL PROCESSING AND SHIPPING TIMELINES ARE ESTIMATES ONLY — NOT GUARANTEES OR PROMISES.

  1. These timelines are indicative and based on typical performance under normal operating conditions. They do not constitute a guaranteed delivery date, a contractual promise, or a service-level commitment.

  2. Actual timelines may vary due to order volume, courier capacity, public holidays, weather, political events, or any other factor beyond our control.

  3. No refund, cancellation, or compensation shall be provided solely on the basis of estimated timelines not being met.

  4. The service tier selected refers strictly to the production/processing approach and/or shipping method. It does not guarantee delivery by any specific date or occasion.

  5. Delays arising solely from estimated timelines not being met shall not, by themselves, constitute deficiency of service.

4.3 Premium Fees Are Non-Refundable

Express and Rush service fees are non-refundable once production has commenced, including in cases of courier delays, force majeure, or other factors beyond Quinns Arte's control.

4.4 Event and Occasion Disclaimer

Our products are frequently purchased for specific occasions such as birthdays, anniversaries, weddings, and Valentine's Day. However, Quinns Arte does not guarantee delivery by any specific date and is not liable for missed events, missed occasions, or consequential emotional or financial losses arising from delivery not meeting an expected date. Customers are strongly advised to order well in advance of their required date.

 


 

5. SHIPPING AND PROOF OF DELIVERY

5.1 Dispatch and Courier as Independent Third Party

Orders are dispatched via reputed third-party courier partners including BlueDart, Delhivery, FedEx, India Post, and other logistics providers. Quinns Arte acts solely as a facilitator for shipping services. The courier is an independent third-party service provider, and Quinns Arte has no operational control over the courier's delivery process, timelines, or conduct.

A tracking number (AWB) will be shared via email and/or WhatsApp upon dispatch. Once dispatched, Quinns Arte's obligation of dispatch is fulfilled.

5.2 Delivery Status as Prima Facie Evidence

The delivery status reflected in the courier partner's digital tracking system (showing "Delivered") shall be treated as prima facie evidence that the package was successfully delivered to the address provided by the Customer, subject to verification in case of genuine disputes raised within the stipulated timeframe.

Additional delivery evidence may include:

  • Digital signature of recipient

  • OTP verification provided by the Customer or recipient

  • GPS coordinates and timestamp of delivery

  • Photograph captured by the courier at point of delivery

5.3 Risk Transfer

Once the courier marks an order as "Delivered," the risk of loss, theft, or damage to the package passes to the Customer.

5.4 Customer Obligations for Delivery

  1. You must be available to receive delivery or authorize a responsible person on your behalf.

  2. The courier will make up to 3 delivery attempts. Failure to receive after 3 attempts will result in Return to Origin (RTO).

  3. You are solely responsible for providing a complete, accurate, and deliverable shipping address. Quinns Arte shall not be liable for delivery failures arising from incorrect or incomplete addresses.

5.5 Return to Origin (RTO) Policy

If a package is returned to us due to customer unavailability, incorrect address, or refusal to accept delivery:

  1. NO REFUND shall be issued.

  2. Re-dispatch may be requested upon payment of full shipping charges plus a handling fee of Rs. 200.

  3. If re-dispatch is not requested within 10 business days of RTO, the order shall be deemed abandoned with no entitlement to refund or replacement.

5.6 Force Majeure

Quinns Arte shall not be liable for delays or failures caused by circumstances beyond its reasonable control including acts of God, natural disasters, floods, earthquakes, war, terrorism, pandemics, government restrictions, political unrest, labor disputes, courier operational failures, or any other force majeure event.

 


 

6. CLAIMS FOR DAMAGED, DEFECTIVE, OR INCORRECT PRODUCTS

6.1 Eligibility for Claims

Claims will only be considered in the following circumstances:

  • Clear manufacturing defects significantly affecting usability

  • Products damaged during transit due to inadequate packaging or courier mishandling

  • Wrong product delivered due to Quinns Arte's fulfillment error

  • Incomplete order (fewer items than ordered and paid for)

  • Empty or tampered packaging

6.2 Mandatory Unboxing Video Requirement

To protect both parties, ALL claims must be accompanied by a valid unboxing video. Claims submitted without a valid unboxing video will not be processed.

The unboxing video MUST meet all of the following requirements:

  1. Recorded in ONE CONTINUOUS TAKE — no cuts, edits, pauses, or breaks

  2. Must begin by showing the SEALED, UNOPENED package from all four sides, clearly displaying the shipping label, AWB tracking label, and all security seals/tape intact

  3. Must show the entire unboxing in real time, including removal of all packing material

  4. Must clearly show each item and highlight any alleged defect, damage, or discrepancy

  5. Must be well-lit, clear, and of sufficient resolution to identify the product and any issue

  6. Must be recorded with a visible timestamp matching the delivery date

6.3 Reporting Window

All claims must be reported to Quinns Arte at [INSERT OFFICIAL SUPPORT EMAIL] within 24 HOURS of the courier marking the order as "Delivered." Claims raised after 24 hours will not be entertained.

The claim must include: order number and Customer details, detailed description of the issue, unboxing video link (Google Drive / Dropbox with sharing enabled), and clear photographs of the alleged defect.

6.4 Claim Review and Resolution

  1. Claims will be reviewed within 3–5 business days of receipt.

  2. If the claim is determined valid, ONE of the following remedies may be offered: Replacement of affected item(s), Store Credit for item value, or Partial Refund limited to affected item(s) only.

  3. Our decision shall be final for internal resolution purposes, without prejudice to the Customer's statutory rights under applicable law.

  4. No full refund of the entire order will be provided for single-item claims.

 


 

7. CANCELLATION AND MODIFICATION

7.1 No Cancellations by Customer

Once an order is placed and payment received, it CANNOT be cancelled. This policy applies regardless of order value, time elapsed, or reason — because production commences immediately and materials are committed specifically to each custom order.

7.2 No Modifications After Payment

Order modifications are not permitted after payment is confirmed, including changes to personalization details, product selection, quantity, or delivery address.

7.3 Cancellation by Quinns Arte

Quinns Arte reserves the right to cancel orders in cases of payment fraud, material unavailability, pricing errors, or force majeure, with a full refund to the Customer's original payment method.

 


 

8. REFUND POLICY

8.1 General Policy

No refunds shall be provided except in cases explicitly covered under this policy or as required under applicable law.

8.2 Non-Refundable Circumstances

The following do NOT entitle a Customer to a refund: change of mind or buyer's remorse; subjective dissatisfaction with colour, size, or artistic interpretation; delivery delays caused by courier or force majeure; customer unavailability or wrong address; personalization errors made by the Customer; minor handmade variations (Clause 2.3); or missed occasions (Clause 4.4).

8.3 Non-Refundable Charges

The following charges are non-refundable under any circumstances: Express and Rush service fees; outbound shipping charges (unless error was entirely Quinns Arte's); payment gateway convenience fees; and gift wrapping/add-on charges (unless defective).

 


 

9. LIMITATION OF LIABILITY

9.1 Maximum Liability Cap

Notwithstanding any other provision, Quinns Arte's total liability to the Customer for any claim shall be strictly limited to the actual amount paid by the Customer for the specific affected product(s) in the order.

9.2 Exclusion of Consequential Damages

Quinns Arte shall not be liable for any indirect, incidental, special, consequential, or punitive damages including loss of profits, business opportunity, emotional distress, reputational harm, or costs arising from missed events, regardless of the legal theory, even if advised of the possibility of such damages.

 


 

10. DIGITAL RECORDS AND PROOF STACK

Quinns Arte maintains digital records for every order, including but not limited to order confirmations, customer communication logs, design approval records, production records, dispatch proof, AWB tracking history, and courier delivery confirmations. These records may be used by Quinns Arte for internal resolution, dispute handling, chargeback responses, or legal proceedings where required.

 


 

11. CUSTOMER MISUSE CLAUSE

Any misuse of Quinns Arte's policies — including but not limited to filing false damage claims, providing fraudulent unboxing videos, initiating unjustified chargebacks, or making dishonest representations to obtain refunds or replacements — shall be considered a breach of this Agreement. Quinns Arte reserves the right to deny current and future services to any Customer found to have engaged in such misuse, and to pursue appropriate legal remedies where warranted.

 


 

12. INTELLECTUAL PROPERTY

12.1 Ownership

All Website content including text, graphics, logos, images, product designs, videos, and software is the exclusive property of Quinns Arte or its licensors and is protected under Indian and international intellectual property laws.

12.2 Restrictions

Customers are granted a limited, non-exclusive, non-transferable license to access the Website for personal, non-commercial purposes only. You may not reproduce, distribute, or create derivative works of any Website content without prior written permission.

12.3 Customer-Provided Content

By uploading photographs, text, or other content for customization, you grant Quinns Arte a worldwide, royalty-free, perpetual license to use such content solely for order fulfillment. Quinns Arte may also use anonymized or watermarked versions for marketing purposes unless you explicitly opt out.

 


 

13. DISPUTE RESOLUTION AND JURISDICTION

13.1 Grievance Officer

13.2 Mandatory Pre-Legal Step

Before initiating any legal proceedings, the Customer must submit a written complaint to the Grievance Officer and allow 15 business days for investigation and good-faith resolution.

13.3 Governing Law and Jurisdiction

This Agreement is governed by the laws of India. Subject to applicable law, disputes arising out of or relating to this Agreement shall be subject to the jurisdiction of the courts in Udaipur, Rajasthan, India. Nothing in this clause shall be construed to limit any statutory rights available to the Customer under the Consumer Protection Act, 2019.

 


 

14. GENERAL PROVISIONS

14.1 Amendments

Quinns Arte reserves the right to modify these Terms at any time. Continued use of the Website after updates constitutes acceptance of the revised Terms.

14.2 Severability

If any provision is found invalid or unenforceable, such provision shall be severed and the remaining Terms shall continue in full force.

14.3 Waiver

Failure to enforce any right shall not constitute a waiver of that right.

14.4 Entire Agreement

This Agreement constitutes the entire agreement between the Customer and Quinns Arte and supersedes all prior representations and understandings.
